TERMS OF SERVICE

These Terms of Service govern your access to and use of the website www.Route50Apparel.com and all related services, products, content, features, and functionality (collectively, the “Services”) offered by Route 50 Apparel LLC, a Maryland limited liability company (“Route 50 Apparel,” “we,” “us,” or “our”).

 

By accessing or using the Services, you agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services. These Terms constitute a binding legal agreement between you and Route 50 Apparel LLC.

 

1.     Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the Services. By using the Services, you represent that you have full legal authority and capacity to enter into this agreement.

2.     Account Responsibility

You are responsible for safeguarding your account credentials and for all activity occurring under your account. We reserve the right to suspend or terminate accounts at our sole discretion for violation of these Terms or suspected fraud.

3.     Products and Apparel Disclaimer

All products are provided for general consumer use only. We do not guarantee specific fit, performance, durability, or suitability for athletic, tactical, political, or event-related use. Apparel may vary slightly in sizing, fabric feel, stitching, coloration, and appearance. You assume all responsibility for determining whether any product is appropriate for your intended use. Route 50 Apparel LLC shall not be liable for injuries, allergic reactions, fabric sensitivities, misuse, alterations, or modifications of products. Products are not certified safety equipment unless expressly stated.

4.     Order Acceptance

An order constitutes an offer to purchase. Acceptance occurs only when shipment confirmation is issued. We reserve the right to cancel any order for pricing errors, suspected fraud, inventory limitations, or other business reasons.

5.     Payment, Fraud and Chargebacks

You represent that you are authorized to use the payment method submitted. We reserve the right to cancel orders flagged for fraud risk. If you initiate a chargeback without first contacting us for resolution, you are in material breach of these Terms. We may dispute the chargeback, submit transaction records and delivery confirmation, recover administrative costs, and restrict future purchases. You agree to reimburse us for costs incurred in responding to fraudulent disputes or payment reversals.

6.     Shipping and Risk of Loss

Title and risk of loss transfer to you upon delivery to the carrier. We are not liable for carrier delays, lost packages marked delivered, customs delays, weather events, or other circumstances beyond our control.

7.     Returns

Returns are governed exclusively by our posted Refund Policy. No additional or implied return rights exist outside that policy.

8.     Intellectual Property

All trademarks, logos, slogans, product names, graphics, designs, and content are the exclusive property of Route 50 Apparel LLC or its licensors. You may not reproduce, distribute, modify, scrape, reverse engineer, or commercially exploit any portion of the Services without prior written consent. Unauthorized use may result in civil and criminal liability.

9.     No Affiliation Disclaimer

Route 50 Apparel LLC is an independent apparel brand. We are not affiliated with, endorsed by, sponsored by, or connected to any other entity, organization, political committee, campaign, advocacy group, or initiative using the name “No Moore” or similar language. Any perceived similarity does not create affiliation, endorsement, or partnership.

10.  Political Merchandise and Expressive Content Disclaimer

Route 50 Apparel LLC may offer apparel containing political themes, slogans, satire, commentary, or expressive content. All such products represent independent expressive merchandise created and distributed solely by Route 50 Apparel LLC. Unless expressly stated, no product is official campaign merchandise. We are not affiliated with, authorized by, endorsed by, sponsored by, or coordinated with any candidate, political committee, political party, advocacy organization, or ballot initiative. The purchase of any product does not constitute a political contribution or donation under federal or Maryland law. Purchases are retail consumer transactions only. No portion of any purchase price is forwarded to any candidate or political committee unless explicitly disclosed.

11.  Expressive Content, Satire, and Parody Disclaimer

Certain products may contain political commentary, satire, parody, opinion, rhetorical slogans, artistic expression, or other expressive content protected under the First Amendment of the United States Constitution. Any slogans or statements appearing on products are expressions of opinion, commentary, humor, or satire and are not statements of verifiable fact. Products referencing public officials or public matters constitute protected commentary on matters of public concern. No product should be interpreted as making factual allegations about any individual or organization. Purchasers acknowledge that satire and parody are expressive techniques and are not literal claims. You assume responsibility for your decision to wear or display expressive merchandise and any resulting consequences. Route 50 Apparel LLC does not intend to defame or make false factual claims about any individual or entity.

 

 

You agree to indemnify and hold harmless Route 50 Apparel LLC from claims arising from your public display of products, third-party interpretation of slogans, use in political settings or events, or claims that your use implies endorsement or affiliation. Route 50 Apparel LLC shall not be liable for reputational, political, social, employment, or economic consequences resulting from your use of expressive merchandise.

 

12.  User Content and Feedback

By submitting reviews, comments, images, or other content, you grant Route 50 Apparel LLC a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, publish, and display such content for marketing or operational purposes. You represent that your submissions do not infringe third-party rights.

13.  DMCA Copyright Policy

If you believe your copyrighted material has been used improperly, you may submit a written DMCA notice including identification of the copyrighted work, identification of the allegedly infringing material, your contact information, and statements under penalty of perjury. Notices may be sent to info@Route50Apparel.com. We reserve the right to remove content and terminate repeat infringers.

14.  Prohibited Use

You agree not to violate any law, engage in fraud, use automated scraping tools, transmit malware, reverse engineer the website, interfere with security, or misuse the Services. Violations may result in termination and legal action.

15.  Disclaimer of Warranties

The Services and all products are provided “as is” and “as available.” We disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

16.  Limitation of Liability

To the maximum extent permitted by law, Route 50 Apparel LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages. Our total liability for any claim shall not exceed the amount paid by you for the product giving rise to the claim.

17.  Expanded Limitation for Political or Expressive Claims

We shall not be liable for claims alleging reputational harm, emotional distress from expressive content, political disagreement, social backlash, employment consequences, or third-party interpretation of slogans. Damages for any expressive content claim are limited to a refund of the purchase price.

18.  Cybersecurity and Data Limitation

We implement reasonable security measures but cannot guarantee absolute security. We are not liable for unauthorized access, data breaches, hacking, third-party service failures, or cyber incidents beyond our control.

19.  Force Majeure

We are not responsible for delays or failures due to events beyond our reasonable control including natural disasters, government actions, supply chain disruptions, labor disputes, carrier failures, or cyberattacks.

20.  Mandatory Exhaustion of Administrative Remedies

As a condition precedent to initiating arbitration, litigation, chargebacks, regulatory complaints, or any formal legal action, you must first exhaust all administrative dispute resolution procedures made available by Route 50 Apparel LLC. These may include customer service review, written dispute submission, internal claims evaluation, refund review, or fraud verification. You agree to cooperate in good faith and provide requested documentation.

 

 

Failure to complete the administrative process constitutes a material breach and may result in dismissal or stay of your claim to the fullest extent permitted by law. Each party shall bear its own costs of participation. If you retain legal counsel during administrative review, all such fees and expenses are solely your responsibility unless otherwise required by law.

 

21.  Pre-Suit Notice and Cure Period

Before initiating arbitration or legal proceedings, you must provide written notice describing your claim and requested relief. Route 50 Apparel LLC shall have thirty days to investigate and attempt resolution before any formal action may be filed.

22.  Arbitration and Class Action Waiver

All disputes shall be resolved by binding arbitration in Maryland under the rules of the American Arbitration Association. You waive any right to participate in a class or collective action. If arbitration is found unenforceable, disputes shall be resolved by a judge without a jury in St. Mary’s County, Maryland.

23.  Jury Trial Waiver

To the fullest extent permitted by law, you waive the right to a trial by jury.

24.  Attorneys’ Fees

In any dispute arising under these Terms, the prevailing party shall be entitled to recover reasonable attorneys’ fees and costs to the extent permitted by law.

25.  Statute of Limitations

Any claim arising from use of the Services must be brought within one year of the event giving rise to the claim unless a longer period is required by law.

26.  Maryland Consumer Protection Act Savings Clause

Nothing in these Terms waives rights that cannot be waived under applicable consumer protection laws. Any unenforceable provision shall be modified to the minimum extent necessary to comply with law while preserving intent.

27.  Governing Law

These Terms are governed by the laws of the State of Maryland. Venue for any permitted court action lies exclusively in St. Mary’s County, Maryland.

28.  Severability

If any provision is unenforceable, the remaining provisions remain in effect.

29.  Assignment

We may assign these Terms at any time. You may not assign your rights without written consent.

30.  Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and Route 50 Apparel LLC.
